Plaintiff-appellant's complaint requested declaratory judgment pursuant to 28 U.S.C. § 2201 to determine the respective rights and obligations of the parties with respect to certain securities. Defendants-appellees counterclaimed, alleging, inter alia, that the plaintiff-appellant owed them approximately $33,000. Vacated and Remanded.
